Abstract

Patent is considered as protection for invention or any idea. Patent Act of 1970 does not describe about the infringement activities. It only specifies the rights provided to the patent holder. Any violation of these rights is called as infringement. Unauthorized using, manufacturing, selling, and importing the invention before the expiry of the patent is said to be infringement. The paper describes the different types of infringement activities and the punishment provided for infringement as per the Patents Act. The paper also specifies some activities which are not considered as infringement. The paper also mentions some infringement cases that happened in India.
